Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the web application operated by Tiny Equations Pte. Ltd. (“Tiny Equations”, “we”, “our”, or “us”) and accessible at app.tinyeqn.com and at its pre-release environment, staging.tinyeqn.com (together, the “Platform”). These Terms apply equally to both. The Platform provides AI-assisted educational tools, currently TinyMark (AI-assisted marking of submitted work) and TinyQ (AI-generated practice questions and mastery tracking), together with such further tools as we may make available from time to time (collectively, the “Services”).

By registering for or accessing the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform. These Terms apply separately from any terms governing Tiny Equations' main marketing website at www.tinyeqn.com.

If you are accessing the Platform on behalf of a school, institution, or organisation, you represent that you have the authority to bind that entity to these Terms, and references to “you” shall include that entity.

2. Definitions

• “Platform” means the web application accessible at app.tinyeqn.com (the “Production Environment”) and its pre-release environment at staging.tinyeqn.com (the “Staging Environment”), and references to the Platform include both.
• “Services” means all AI-assisted educational tools and features made available on the Platform, including TinyMark and TinyQ, together with any outputs surfaced to users by the Mastery Intelligence System.
• “User” means any individual who registers for or accesses the Platform.
• “Institution” means a school, educational institution, or organisation that has entered into a separate B2B agreement or pilot arrangement with Tiny Equations, whether directly or through a Local Partner.
• “Local Partner” means an organisation appointed by Tiny Equations in a country outside Singapore to coordinate the deployment of the Platform to Institutions in that country, as listed in our Privacy Policy.
• “Institution-Linked Account” means an account created or managed in connection with an Institution's subscription or pilot, including accounts held by school administrators, teachers, and students affiliated with that Institution.
• “B2C Account” means an account registered directly by an individual user independent of any Institution arrangement.
• “Subscription” means access to paid features of the Platform, available under B2B enterprise licensing or B2C paid tier plans.
• “Content” means any material generated, produced, or output by the Services, including AI-generated questions and marking schemes, proposed marks, feedback, annotations, in-product assistant responses, and mastery graphs and concept or topic mastery scores generated by the Mastery Intelligence System.
• “User Data” means any data, text, or information submitted by or on behalf of a User in the course of using the Services, including student submissions (such as photographs, scans and uploaded files of handwritten or typed work), answers, essays, queries, appeals, and teaching materials such as question papers, marking schemes and rubrics uploaded by teachers.
• “Mastery Intelligence System” or “MIS” means the proprietary AI engine developed and operated by Tiny Equations that analyses User Data to assess a user's level of understanding across educational concepts and topics, and which may use third-party AI models provided by our service providers as described in our Privacy Policy. The MIS operates as a backend system and is not directly accessible to users; however, it produces outputs that are surfaced within the Platform, including mastery graphs displaying a user's current concepts or topics and their corresponding mastery scores.
• “Classroom Work” means work submitted by a student to an assignment created by a teacher on the Platform, or uploaded by a teacher on a student's behalf.
• “Personal Practice” means work that a User uploads for marking that is not attached to an assignment created by a teacher.

3. Account Types and Registration

3.1 Account Categories

The Platform supports two categories of accounts:

• Institution-Linked Accounts (B2B Enterprise), which include accounts for school administrators, teachers, and students under a formal arrangement between Tiny Equations and an Institution, whether made directly or through a Local Partner. These accounts are governed by these Terms together with the separate agreement applicable to the relevant Institution.
• B2C Accounts, registered directly by individual users including teachers, students, and other learners. B2C accounts are available on a free tier or paid subscription basis.

3.2 Account Creation

To access the Platform, you must create an account by providing accurate, complete, and current information. Authentication is provided by Google Cloud Identity Platform (and, where enabled, Sign in with Google), and Tiny Equations does not hold your password. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@tinyeqn.com if you suspect any unauthorised use of your account.

Student accounts under Institutional arrangements are provisioned by Tiny Equations in coordination with the Institution and, where applicable, the relevant Local Partner. B2C accounts may be self-registered by individual users, subject to the age and consent requirements set out in Section 4 below.

3.3 Account Accuracy

You agree not to provide false or misleading information when creating your account, including with respect to your school affiliation or institutional status. Tiny Equations reserves the right to suspend or terminate accounts where inaccurate affiliation information is detected.

4. Minors and Parental or Guardian Consent

The Platform is designed to serve students of all age groups, including primary and secondary school students. We take the privacy and safety of younger users seriously.

Where a user is below 18 years of age and is registering for a B2C Account, parental or guardian consent is required. During the registration process, a parent or legal guardian must provide their details and confirm consent before the account is activated.

Where a parent or legal guardian provides consent for a User below 18 years of age, the parent or guardian accepts these Terms on the User's behalf, agrees to supervise the User's use of the Platform, and is responsible for any fees payable under a paid B2C Subscription. That consent also covers the collection, use and processing of the User's personal data, including processing outside Singapore, as described in our Privacy Policy. The parent or guardian also decides whether the User's data may be used for model training, as described in Section 8.3.

For Institution-Linked Accounts, student accounts are provisioned by Tiny Equations in coordination with the Institution and, where applicable, the relevant Local Partner, and it is the responsibility of the Institution (or, where the Institution is served through a Local Partner, that Local Partner, using forms approved by Tiny Equations) to obtain all necessary parental or guardian consents and, where appropriate, student assent in accordance with applicable laws and school policies before student data is submitted to the Platform.

Tiny Equations reserves the right to take appropriate steps to verify the age of users where required and to suspend accounts where we reasonably believe that required consent has not been obtained.

5. Permitted Use and Acceptable Use Policy

5.1 Permitted Use

You may use the Platform solely for lawful educational purposes and in accordance with these Terms. The Services are intended to assist educators in preparing teaching materials and assessments, and to support students in their learning.

The Staging Environment is provided for testing and demonstration, and for beta deployments and pilots where Tiny Equations has agreed this in writing. Institutions must not submit live student data to the Staging Environment unless Tiny Equations has agreed to this in writing. The Staging Environment may be changed, reset or withdrawn at any time and is provided without any uptime or service-level commitment, and except for data submitted under a beta deployment or pilot agreed in writing, data in it may be deleted without notice.

5.2 Prohibited Conduct

You agree that you will not, and will not permit any third party to:

• use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
• attempt to gain unauthorised access to any part of the Platform or its underlying systems or infrastructure;
• share account credentials with any third party or allow any person other than the registered account holder to use your account;
• reproduce, distribute, modify, create derivative works of, or exploit any Content generated by the Services for commercial purposes outside the scope of your own educational use, without Tiny Equations' prior written consent;
• use the Platform to upload, transmit, or distribute any material that is unlawful, defamatory, abusive, offensive, or that infringes any third-party intellectual property rights;
• upload question papers, marking schemes, rubrics or other teaching materials unless you own them or have the right to upload and use them on the Platform, including any permission required from the relevant examination board, publisher or school;
• include personal data of any other individual in teaching materials or other User Data unless you are authorised to do so;
• reverse engineer, disassemble, decompile, or otherwise attempt to extract the source code or underlying algorithms of the Platform or Services;
• use automated tools, bots, scrapers, or scripts to access or interact with the Platform without our prior written consent;
• misrepresent your identity, your role, or your affiliation with any Institution when using the Platform.

6. Subscriptions, Pilot Programmes, Pricing, and Payment

6.1 B2B Enterprise Subscriptions

Access to the Platform for Institutions is provided under an enterprise subscription arrangement. The specific terms of access, pricing, and success metrics are set out in a separate written agreement with the relevant Institution or, where it is served through a Local Partner, in the arrangements agreed through that Local Partner.

Tiny Equations may offer pilot programmes to prospective institutional clients before a full enterprise subscription begins, which may include free or subsidised trial periods.

The duration, pricing, success metrics and other terms of any pilot are set out in a separately executed agreement with the relevant Institution or agreed through its Local Partner. These Terms apply to the use of the Platform during all pilot phases.

Where an Institution is served through a Local Partner, the Local Partner may invoice and collect fees directly from the Institution for pilots and subscriptions, at pricing approved by Tiny Equations.

6.2 B2C Subscriptions

B2C users may access the Platform under a free tier with limited features, or a paid subscription plan. Paid plans are offered on a monthly or annual basis at the rates published on the Platform at the time of subscription.

By subscribing to a paid plan, you authorise Tiny Equations to charge the applicable fees to your designated payment method on a recurring basis until you cancel your subscription.

6.3 Cancellation

You may cancel your B2C subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to paid features until that date. Tiny Equations does not provide refunds for unused portions of a billing period unless stated otherwise below.

6.4 Refund Policy

Monthly subscription fees are generally non-refundable once charged.

For annual subscriptions, you may request a partial refund within fourteen (14) calendar days from the date of the applicable annual charge. Where such a refund is approved, the refund amount will be calculated as the annual fee paid, less an amount equivalent to one (1) month of the subscription at the then-current standard monthly rate. After the fourteen (14)-day window, annual subscription fees are non-refundable, except where otherwise required by applicable law.

Tiny Equations reserves the right to decline refund requests in cases of abuse, repeated refund requests, unauthorised account sharing, chargebacks, fraudulent activity, or other conduct indicative of bad faith. Duplicate, unauthorised, or erroneous charges are subject to separate review and may be refunded at our discretion or as required by applicable law.

7. Intellectual Property and Content Ownership

7.1 Platform and Services

The Platform, the Services, and all underlying technology, algorithms, software, AI models (including any model trained or fine-tuned using User Data), designs, trademarks, and trade names are the exclusive property of Tiny Equations Pte. Ltd. and its licensors. Nothing in these Terms grants you any rights in or to the Platform or Services other than the limited right of access expressly set out herein.

7.2 Content Generated by the Services

As between you and Tiny Equations, and to the extent that any intellectual property rights subsist in it, all Content generated by the Services, including AI-generated questions produced by TinyQ, proposed marks, annotations and feedback generated by TinyMark, and responses from the in-product assistant, is owned by Tiny Equations Pte. Ltd. Content does not include User Data, including any User Data reproduced within Content (for example, the image of a student's submitted work within a marked assessment). Tiny Equations grants you a limited, non-exclusive, non-transferable licence to access, view, download, and use such Content solely for your own personal or institutional educational purposes.

You may not reproduce, redistribute, resell, sublicence, or exploit Content for commercial purposes without Tiny Equations' prior written consent.

7.3 Downloadable Outputs

You may download feedback reports, marked assessments, and generated questions made available to you through the Platform for your personal or educational use. Downloading Content does not transfer ownership of that Content to you.

7.4 User Data

You retain all rights in User Data that you or your students submit to the Platform. By submitting User Data, you grant Tiny Equations a non-exclusive, worldwide licence to use, process, and analyse that User Data, and to permit our service providers to process it on our behalf, for the purposes of providing, securing and supporting the Services, carrying out quality assurance on the outputs of the Services and, only where permitted under Section 8, training and fine-tuning our AI models, subject to Section 8 below and our Privacy Policy. You confirm that you have all rights and consents necessary to submit User Data to the Platform.

7.5 Feedback

If you provide suggestions, bug reports or other feedback about the Services, whether directly or through a Local Partner, Tiny Equations may use, modify and incorporate that feedback for any purpose, without restriction or compensation to you.

8. Data Privacy and Use

8.1 General

Tiny Equations is committed to handling all personal data and User Data in accordance with applicable data protection laws, including the Personal Data Protection Act 2012 of Singapore (PDPA) and, where we operate through Local Partners, agencies or joint ventures in other countries in the region, such as Malaysia, Myanmar and Indonesia, the Personal Data Protection Act 2010 of Malaysia and other applicable data protection frameworks in those jurisdictions, to the extent required. Full details of our data practices are set out in our Privacy Policy, which prevails over these Terms in relation to the handling of personal data.

8.2 Institution-Linked Accounts

User Data collected in connection with Institution-Linked Accounts (including student submissions, answers, essays, queries, progression scores, assignment grades, appeals, and related educational data) will not be disclosed to any third party, other than the service providers that process data on our behalf as listed in our Privacy Policy and, where applicable, the Local Partner serving that Institution, without the prior written consent of the relevant Institution, except where required by applicable law.

Tiny Equations may use such User Data internally to perform quality assurance on the outputs of the Services (for example, reviewing marking accuracy). Such User Data is not used to train or fine-tune any AI model unless the Institution has agreed to this in a signed written agreement with Tiny Equations and, where the Institution is served through a Local Partner, separate explicit consent covering that use has been obtained from each parent or guardian, and is never sold or disclosed to third parties for commercial or marketing purposes.

Where an Institution agrees that its User Data may be used for model training, the Institution is responsible for informing affected students and their parents or guardians and for obtaining any consents required under applicable law and school policies.

8.3 B2C Accounts

User Data collected from B2C Accounts will not be disclosed to third parties for their own purposes, except to our service providers as described in our Privacy Policy or as required by law. Tiny Equations does not serve advertising of any kind and does not profile users for advertising purposes.

Model training. Tiny Equations may use Training Data (as defined in our Privacy Policy) from B2C Accounts to train and fine-tune its own AI models, after removing direct identifiers, as follows: (a) for Users aged 18 or over, unless you opt out, which you may do at any time in your account settings; and (b) for Users below 18 years of age, only if a parent or guardian has opted in, which they may withdraw at any time. Opting out or withdrawing stops your data being selected for future training; data already included in a de-identified training dataset cannot be identified or removed, and models already trained will not be retrained. Training Data is never sold or shared with third parties for their own model training.

8.4 International Operations and Data Transfers

Application data is stored in Singapore. Certain processing, including AI-assisted marking, optical character recognition, authentication, email delivery, and remote access by our authorised personnel located outside Singapore, takes place outside Singapore as described in Section 10 of our Privacy Policy. By using the Services, you (or, for a User below 18 years of age, your parent or guardian) consent to that processing. Tiny Equations may operate through Local Partners, agencies, or joint venture arrangements in jurisdictions outside Singapore, and personal data is exchanged with Local Partners as described in our Privacy Policy. In such cases, data handling practices will comply with the applicable laws of the relevant jurisdiction, as further described in our Privacy Policy.

8.5 Communications

We will send you transactional communications and notifications about your own work as described in our Privacy Policy. Transactional communications cannot be switched off while your account is active; you may manage email notifications and product updates in your account settings.

9. Data Retention

Tiny Equations will retain User Data for the duration of your account's active period and for a period of six (6) months following the closure or termination of your account. After this period, your User Data will be securely deleted or anonymised, except where we are required to retain it for longer under applicable law.

Where an Institution's subscription ends, the Institution's User Data will be retained for six (6) months from the date on which the subscription or pilot arrangement concludes, after which it will be securely deleted or anonymised.

Retention periods for other categories of data, including de-identified training data, consent records, application logs, security and audit records, and Website enquiries, and our retention of anonymised or aggregated data, are set out in Section 12 of our Privacy Policy.

You may request the deletion of your personal data prior to the expiry of the retention period in accordance with the rights available to you under applicable data protection law, as described in our Privacy Policy.

10. AI-Generated Content — Disclaimer and Responsibilities

The Services employ artificial intelligence technologies to generate questions, provide feedback, propose marks for submitted work, respond to queries through the in-product assistant, and produce mastery graphs and concept or topic mastery scores via the Mastery Intelligence System. While Tiny Equations takes reasonable steps to ensure the quality and accuracy of AI-generated Content, AI systems are inherently subject to errors, limitations, and variability.

AI-generated Content may contain inaccuracies, errors, or omissions. Accordingly:

• Teachers and educators are expected to review all AI-generated Content, including generated questions, marking feedback, and mastery scores, before distributing or applying it in an educational context.
• Students and other learners are expected to seek confirmation or validation from a qualified teacher or educator when in doubt about the accuracy or appropriateness of AI-generated Content.
• Tiny Equations does not warrant the accuracy, completeness, or fitness for purpose of any AI-generated Content and shall not be liable for any consequences arising from reliance on such Content without appropriate human review.

Classroom Work. AI-proposed marks for Classroom Work are reviewed by the responsible teacher, who may amend any score, annotation or comment, and are not visible to the student until the teacher releases them. A student may appeal a released mark through the Platform, and appeals are routed to the responsible teacher.

Personal Practice. Marks for Personal Practice are produced by automated processing alone, without teacher review. They are a study aid only: they are not a grade, are not reported to any school, and carry no academic consequence. The appeal process does not apply to Personal Practice; if you believe a result is wrong, you may disregard it, resubmit, or contact us at support@tinyeqn.com.

Where an Institution uses the Platform, the Institution remains responsible for how released marks are used in its own assessment and reporting.

11. Account Suspension and Termination

11.1 Termination by You

You may close your B2C account at any time by contacting us at support@tinyeqn.com or through your account settings. Closure will take effect within a reasonable time, subject to any outstanding payment obligations.

11.2 Suspension or Termination by Tiny Equations

Tiny Equations may suspend or terminate your account immediately, with or without prior notice, if we reasonably believe that you have:

• violated any provision of these Terms or any applicable law or regulation;
• misused the Services or used them in a manner that creates a safety, privacy, legal, or security risk;
• failed to pay any applicable fees when due;
• provided inaccurate account information or misrepresented your institutional affiliation;
• engaged in fraudulent conduct, abusive behaviour, or conduct that harms Tiny Equations, other users, Institutions, or third parties;
• infringed the intellectual property rights of any person;
• attempted to gain unauthorised access to any part of the Platform; or
• shared account credentials or used the Services in a manner inconsistent with these Terms.

Tiny Equations may also suspend or terminate Institution-Linked Accounts upon the written request of the relevant Institution, or where required for legal or compliance reasons.

11.3 Effect of Termination

Upon termination or suspension, your right to access the Platform ceases immediately. Data retention following termination is as described in Section 9. Termination does not relieve you of any payment obligations that arose prior to termination.

12. Limitation of Liability

12.1 Exclusion of Consequential Losses

To the maximum extent permitted by applicable law, Tiny Equations Pte. Ltd., its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with these Terms or your use of the Services, including loss of profits, revenue, business opportunities, goodwill, data, or use, even if Tiny Equations has been advised of the possibility of such damages.

12.2 Aggregate Liability Cap

To the maximum extent permitted by applicable law, Tiny Equations' total cumulative liability to you for all claims arising out of or relating to the Services or these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the greater of: (a) the total fees paid by you to Tiny Equations in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) Singapore Dollars one hundred (SGD 100).

12.3 Carve-Outs

Nothing in this Section 12 or elsewhere in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law, including any liability arising from death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit to be excluded or limited.

For the avoidance of doubt, the limitations in this Section 12 do not apply to claims arising from Tiny Equations' gross negligence, wilful misconduct, or fraudulent conduct.

13. Disclaimers

The Platform and Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Tiny Equations does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Tiny Equations does not warrant that the AI-generated Content produced by the Services will be accurate, complete, or suitable for any specific educational requirement. Users are solely responsible for evaluating the suitability of Content for their purposes.

14. Changes to These Terms

Tiny Equations reserves the right to modify these Terms at any time. Where changes are material, we will provide not less than seven (7) calendar days' advance notice by posting the updated Terms on the Platform and, where reasonably practicable, by notifying registered users via the email address associated with their account. The date of the most recent update will be reflected at the top of this document.

Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must cease using the Platform before the effective date of the changes.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Where Tiny Equations operates through local partnerships, agencies, or joint ventures in other jurisdictions, any additional or differing legal requirements of those jurisdictions shall apply to the extent required by applicable law.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or their breach, termination, or invalidity, shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved by negotiation within thirty (30) days, the parties agree to submit the dispute to the non-exclusive jurisdiction of the courts of Singapore.

16. General Provisions

• Entire Agreement. These Terms, together with our Privacy Policy and any separately executed institutional agreements, constitute the entire agreement between you and Tiny Equations with respect to the subject matter herein and supersede all prior agreements, representations, or understandings.
• Order of Precedence. For Institution-Linked Accounts, if there is any conflict between these Terms and a separately executed agreement between Tiny Equations and the relevant Institution, the separately executed agreement prevails to the extent of the conflict. In relation to the handling of personal data, our Privacy Policy prevails over these Terms.
• Local Partners. Local Partners are independent contractors and not agents of Tiny Equations. They are not authorised to make any representation, warranty or commitment on Tiny Equations' behalf, or to vary these Terms, beyond what Tiny Equations has approved in writing.
• Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
• No Waiver. Tiny Equations' failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Tiny Equations may assign its rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of all or substantially all of its assets.
• Language. These Terms are drafted in the English language. In the event of any inconsistency between the English version and any translation, the English version shall prevail.
