1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the web application operated by Tiny Equations Pte. Ltd. (“Tiny Equations”, “we”, “our”, or “us”) and accessible at app.tinyeqn.com (the “Platform”). The Platform provides AI-powered educational tools including TinyMark, TinyQ, and TinyTeach (collectively, the “Services”).

By registering for or accessing the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform. These Terms apply separately from any terms governing Tiny Equations' main marketing website at www.tinyeqn.com.

If you are accessing the Platform on behalf of a school, institution, or organisation, you represent that you have the authority to bind that entity to these Terms, and references to “you” shall include that entity.

2. Definitions

  • “Platform” means the web application accessible at app.tinyeqn.com.
  • “Services” means all AI-powered educational tools and features made available on the Platform, including TinyMark, TinyQ, and TinyTeach, together with any outputs surfaced to users by the Mastery Intelligence System.
  • “User” means any individual who registers for or accesses the Platform.
  • “Institution” means a school, educational institution, or organisation that has entered into a separate B2B agreement or pilot arrangement with Tiny Equations.
  • “Institution-Linked Account” means an account created or managed in connection with an Institution's subscription or pilot, including accounts held by school administrators, teachers, and students affiliated with that Institution.
  • “B2C Account” means an account registered directly by an individual user independent of any Institution arrangement.
  • “Subscription” means access to paid features of the Platform, available under B2B enterprise licensing or B2C paid tier plans.
  • “Content” means any material generated, produced, or output by the Services, including AI-generated questions, markings, feedback reports, tutoring responses, and mastery graphs and concept or topic mastery scores generated by the Mastery Intelligence System.
  • “User Data” means any data, text, or information submitted by or on behalf of a User in the course of using the Services, including student submissions, answers, essays, and queries.
  • “Mastery Intelligence System” or “MIS” means the proprietary AI engine developed and operated by Tiny Equations that analyses User Data to assess a user's level of understanding across educational concepts and topics. The MIS operates as a backend system and is not directly accessible to users; however, it produces outputs that are surfaced within the Platform, including mastery graphs displaying a user's current concepts or topics and their corresponding mastery scores.

3. Account Types and Registration

3.1 Account Categories

The Platform supports two categories of accounts:

  • Institution-Linked Accounts (B2B Enterprise), which include accounts for school administrators, teachers, and students under a formal arrangement between Tiny Equations and an Institution. These accounts are governed by these Terms together with the separate agreement entered into between Tiny Equations and the relevant Institution.
  • B2C Accounts, registered directly by individual users including teachers, students, and other learners. B2C accounts are available on a free tier or paid subscription basis.

3.2 Account Creation

To access the Platform, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@tinyeqn.com if you suspect any unauthorised use of your account.

Student accounts under Institutional arrangements are created by Tiny Equations on behalf of the Institution. B2C accounts may be self-registered by individual users, subject to the age and consent requirements set out in Section 4 below.

3.3 Account Accuracy

You agree not to provide false or misleading information when creating your account, including with respect to your school affiliation or institutional status. Tiny Equations reserves the right to suspend or terminate accounts where inaccurate affiliation information is detected.

4. Minors and Parental or Guardian Consent

The Platform is designed to serve students of all age groups, including primary and secondary school students. We take the privacy and safety of younger users seriously.

Where a user is below 18 years of age and is registering for a B2C Account, parental or guardian consent is required. During the registration process, a parent or legal guardian must provide their details and confirm consent before the account is activated.

For Institution-Linked Accounts, student accounts are provisioned by Tiny Equations in coordination with the Institution, and it is the responsibility of the Institution to obtain all necessary parental or guardian consents in accordance with applicable laws and school policies before student data is submitted to the Platform.

Tiny Equations reserves the right to take appropriate steps to verify the age of users where required and to suspend accounts where we reasonably believe that required consent has not been obtained.

5. Permitted Use and Acceptable Use Policy

5.1 Permitted Use

You may use the Platform solely for lawful educational purposes and in accordance with these Terms. The Services are intended to assist educators in preparing teaching materials and assessments, and to support students in their learning.

5.2 Prohibited Conduct

You agree that you will not, and will not permit any third party to:

  • use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
  • attempt to gain unauthorised access to any part of the Platform or its underlying systems or infrastructure;
  • share account credentials with any third party or allow any person other than the registered account holder to use your account;
  • reproduce, distribute, modify, create derivative works of, or exploit any Content generated by the Services for commercial purposes outside the scope of your own educational use, without Tiny Equations' prior written consent;
  • use the Platform to upload, transmit, or distribute any material that is unlawful, defamatory, abusive, offensive, or that infringes any third-party intellectual property rights;
  • reverse engineer, disassemble, decompile, or otherwise attempt to extract the source code or underlying algorithms of the Platform or Services;
  • use automated tools, bots, scrapers, or scripts to access or interact with the Platform without our prior written consent;
  • misrepresent your identity, your role, or your affiliation with any Institution when using the Platform.

6. Subscriptions, Pilot Programmes, Pricing, and Payment

6.1 B2B Enterprise Subscriptions

Access to the Platform for Institutions is provided under an enterprise subscription arrangement. The specific terms of access, pricing, and success metrics are set out in a separate written agreement between Tiny Equations and the relevant Institution.

Tiny Equations currently offers two types of pilot programmes for prospective institutional clients, prior to the commencement of a full enterprise subscription:

  • Commitment Pilot (Type A): A limited number of teachers from the Institution may use the Platform during a free trial period of a fixed duration. Following the trial, the Institution may participate in an officially structured pilot at no cost for a fixed number of school terms, on the condition that the Institution has agreed in writing to subscribe to a one-year enterprise subscription if the pilot meets the agreed success metrics.
  • Non-Commitment Pilot (Type B): A limited number of teachers may use the Platform during a free trial period of a fixed duration. The Institution may then participate in a structured pilot at a subsidised cost for a fixed number of school terms, without a prior commitment to a full subscription.

The specific duration of each phase, success metrics, subsidised pricing, and other pilot terms are agreed in separately executed contracts with individual Institutions. These Terms apply to the use of the Platform during all pilot phases.

6.2 B2C Subscriptions

B2C users may access the Platform under a free tier with limited features, or a paid subscription plan. Paid plans are offered on a monthly or annual basis at the rates published on the Platform at the time of subscription.

By subscribing to a paid plan, you authorise Tiny Equations to charge the applicable fees to your designated payment method on a recurring basis until you cancel your subscription.

6.3 Cancellation

You may cancel your B2C subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to paid features until that date. Tiny Equations does not provide refunds for unused portions of a billing period unless stated otherwise below.

6.4 Refund Policy

Monthly subscription fees are generally non-refundable once charged.

For annual subscriptions, you may request a partial refund within fourteen (14) calendar days from the date of the applicable annual charge. Where such a refund is approved, the refund amount will be calculated as the annual fee paid, less an amount equivalent to one (1) month of the subscription at the then-current standard monthly rate. After the fourteen (14)-day window, annual subscription fees are non-refundable, except where otherwise required by applicable law.

Tiny Equations reserves the right to decline refund requests in cases of abuse, repeated refund requests, unauthorised account sharing, chargebacks, fraudulent activity, or other conduct indicative of bad faith. Duplicate, unauthorised, or erroneous charges are subject to separate review and may be refunded at our discretion or as required by applicable law.

7. Intellectual Property and Content Ownership

7.1 Platform and Services

The Platform, the Services, and all underlying technology, algorithms, software, designs, trademarks, and trade names are the exclusive property of Tiny Equations Pte. Ltd. and its licensors. Nothing in these Terms grants you any rights in or to the Platform or Services other than the limited right of access expressly set out herein.

7.2 Content Generated by the Services

All Content generated by the Services, including AI-generated questions produced by TinyQ, markings and feedback generated by TinyMark, and tutoring responses generated by TinyTeach, is owned by Tiny Equations Pte. Ltd. Tiny Equations grants you a limited, non-exclusive, non-transferable licence to access, view, download, and use such Content solely for your own personal or institutional educational purposes.

You may not reproduce, redistribute, resell, sublicence, or exploit Content for commercial purposes without Tiny Equations' prior written consent.

7.3 Downloadable Outputs

You may download feedback reports, marked assessments, and generated questions made available to you through the Platform for your personal or educational use. Downloading Content does not transfer ownership of that Content to you.

7.4 User Data

You retain all rights in User Data that you or your students submit to the Platform. By submitting User Data, you grant Tiny Equations a non-exclusive, worldwide licence to use, process, and analyse that User Data for the purposes of providing the Services and improving the quality of our AI models, subject to the conditions set out in Section 8 below.

8. Data Privacy and Use

8.1 General

Tiny Equations is committed to handling all personal data and User Data in accordance with applicable data protection laws, including the Personal Data Protection Act 2012 of Singapore (PDPA), the Personal Data Protection Act 2010 of Malaysia, and other applicable privacy regulations in the jurisdictions in which we operate. Full details of our data practices are set out in our Privacy Policy.

8.2 Institution-Linked Accounts

User Data collected in connection with Institution-Linked Accounts (including student submissions, answers, essays, queries, progression scores, assignment grades, and related educational data) will not be disclosed to any third party without the prior written consent of the relevant Institution, except where required by law or as described in these Terms.

Tiny Equations may use such User Data internally to perform quality assurance on model outputs and to improve the accuracy and quality of the feedback and content generated by the Services. This use is limited to improving the Services and does not include the sale or disclosure of such data to third parties for commercial or marketing purposes.

8.3 B2C Accounts

User Data collected from B2C accounts will not be disclosed to third parties without your consent. You will have the option to opt in to sharing your data for the purpose of receiving personalised advertisements. This election will be presented to you via a clearly labelled consent pop-up when you first register for the Platform. You may change your advertising preferences at any time through your account settings.

8.4 International Operations

Tiny Equations may operate through local partnerships, agencies, or joint venture arrangements in jurisdictions outside Singapore. In such cases, data handling practices will comply with the applicable laws of the relevant jurisdiction, as further described in our Privacy Policy.

9. Data Retention

Tiny Equations will retain User Data for the duration of your account's active period and for a period of six (6) months following the closure or termination of your account. After this period, your User Data will be securely deleted or anonymised, except where we are required to retain it for longer under applicable law.

Where an Institution's subscription ends, the Institution's User Data will be retained for six (6) months from the date on which the subscription or pilot arrangement concludes, after which it will be securely deleted or anonymised.

You may request the deletion of your personal data prior to the expiry of the retention period in accordance with the rights available to you under applicable data protection law, as described in our Privacy Policy.

10. AI-Generated Content — Disclaimer and Responsibilities

The Services employ artificial intelligence technologies to generate questions, provide feedback, mark assessments, deliver tutoring support, and produce mastery graphs and concept or topic mastery scores via the Mastery Intelligence System. While Tiny Equations takes reasonable steps to ensure the quality and accuracy of AI-generated Content, AI systems are inherently subject to errors, limitations, and variability.

AI-generated Content may contain inaccuracies, errors, or omissions. Accordingly:

  • Teachers and educators are expected to review all AI-generated Content, including generated questions, marking feedback, and mastery scores, before distributing or applying it in an educational context.
  • Students and other learners are expected to seek confirmation or validation from a qualified teacher or educator when in doubt about the accuracy or appropriateness of AI-generated Content.
  • Tiny Equations does not warrant the accuracy, completeness, or fitness for purpose of any AI-generated Content and shall not be liable for any consequences arising from reliance on such Content without appropriate human review.

11. Account Suspension and Termination

11.1 Termination by You

You may close your B2C account at any time by contacting us at support@tinyeqn.com or through your account settings. Closure will take effect within a reasonable time, subject to any outstanding payment obligations.

11.2 Suspension or Termination by Tiny Equations

Tiny Equations may suspend or terminate your account immediately, with or without prior notice, if we reasonably believe that you have:

  • violated any provision of these Terms or any applicable law or regulation;
  • misused the Services or used them in a manner that creates a safety, privacy, legal, or security risk;
  • failed to pay any applicable fees when due;
  • provided inaccurate account information or misrepresented your institutional affiliation;
  • engaged in fraudulent conduct, abusive behaviour, or conduct that harms Tiny Equations, other users, Institutions, or third parties;
  • infringed the intellectual property rights of any person;
  • attempted to gain unauthorised access to any part of the Platform; or
  • shared account credentials or used the Services in a manner inconsistent with these Terms.

Tiny Equations may also suspend or terminate Institution-Linked Accounts upon the written request of the relevant Institution, or where required for legal or compliance reasons.

11.3 Effect of Termination

Upon termination or suspension, your right to access the Platform ceases immediately. Data retention following termination is as described in Section 9. Termination does not relieve you of any payment obligations that arose prior to termination.

12. Limitation of Liability

12.1 Exclusion of Consequential Losses

To the maximum extent permitted by applicable law, Tiny Equations Pte. Ltd., its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with these Terms or your use of the Services, including loss of profits, revenue, business opportunities, goodwill, data, or use, even if Tiny Equations has been advised of the possibility of such damages.

12.2 Aggregate Liability Cap

To the maximum extent permitted by applicable law, Tiny Equations' total cumulative liability to you for all claims arising out of or relating to the Services or these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the greater of: (a) the total fees paid by you to Tiny Equations in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) Singapore Dollars one hundred (SGD 100).

12.3 Carve-Outs

Nothing in this Section 12 or elsewhere in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law, including any liability arising from death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit to be excluded or limited.

For the avoidance of doubt, the limitations in this Section 12 do not apply to claims arising from Tiny Equations' gross negligence, wilful misconduct, or fraudulent conduct.

13. Disclaimers

The Platform and Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Tiny Equations does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Tiny Equations does not warrant that the AI-generated Content produced by the Services will be accurate, complete, or suitable for any specific educational requirement. Users are solely responsible for evaluating the suitability of Content for their purposes.

14. Changes to These Terms

Tiny Equations reserves the right to modify these Terms at any time. Where changes are material, we will provide not less than seven (7) calendar days' advance notice by posting the updated Terms on the Platform and, where reasonably practicable, by notifying registered users via the email address associated with their account. The date of the most recent update will be reflected at the top of this document.

Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must cease using the Platform before the effective date of the changes.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Where Tiny Equations operates through local partnerships, agencies, or joint ventures in other jurisdictions, any additional or differing legal requirements of those jurisdictions shall apply to the extent required by applicable law.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or their breach, termination, or invalidity, shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved by negotiation within thirty (30) days, the parties agree to submit the dispute to the non-exclusive jurisdiction of the courts of Singapore.

16. General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy and any separately executed institutional agreements, constitute the entire agreement between you and Tiny Equations with respect to the subject matter herein and supersede all prior agreements, representations, or understandings.
  • Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
  • No Waiver. Tiny Equations' failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Tiny Equations may assign its rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of all or substantially all of its assets.
  • Language. These Terms are drafted in the English language. In the event of any inconsistency between the English version and any translation, the English version shall prevail.
